Background
Criminals have gained access to the payment card data of people who have used their cards at Trump hotels. Trump Hotel Properties first became aware of the data breach on July 1, 2015. However, news of a possible breach first surfaced in February. The February report indicated that banks noticed a pattern of fraudulent debit and credit card charges to accounts that had all been used at Trump hotels. If true it would mean that thieves had access to the payment card information for months.
The Trump Hotel Collection is the name for the group of hotels owned by the Trump Organization. The Trump Hotel Collection includes luxury hotels located in New York, Chicago, Las Vegas, Waikiki, Miami, Washington D.C, and several other international locations.
Data Breach
A data breach occurs when an unauthorized person views, accesses, or retrieves protected or confidential data belonging to another. There are several types of data breaches but one of the most common forms is the point-of-sale malware attack. Point-of-sale malware, or POS malware, is malicious software designed by hackers to steal customer payment data from retail checkout systems. Since nearly all payment information must go through a cash register or payment processing computer, it has become a popular point for thieves to target. Once a criminal gains access to the payment data on POS systems they can use the individual payment card numbers to make fraudulent purchases or even sell the financial information of the victims in bulk to other criminal parties. Payment card data breaches are on the rise. Advances in technology make acquiring POS systems easier. However, by using standardized commercial POS systems, retailers are making it easier for criminals to gain access. Hackers are always creating new forms of malware to steal data but security measures are not keeping pace.
Potential Class Action
Trump hotels have suffered a data breach. The breach may have being going on for months, allowing thieves time to make fraudulent purchases or sell the victims’ information. Because of the extent of the data breach a class action lawsuit may provide a better option to provide restitution to the affected victims. Class actions are less of a burden on individual victims and allow many people to receive a fair remedy at law.
