Santander Data Breach Background

Santander Bank is involved in a recent data breach which has threatened the security of its employees.  Information including personal data such as name, date of birth, and social security number is affected. Employees were informed by letter sent March 16, 2016 via United States Postal Service mail of Santander Bank’s security breach. The notice informed employees that information was compromised related to a data breach that was emailed outside of company firewalls in December, 2015. A data breach occurs when a person who does not have permission to access private information of another, is able to view or access that information through no fault of the person whose information has been compromised.

Santander Bank has locations in Connecticut, Delaware, Massachusetts, New Hampshire, New Jersey, New York, Pennsylvania, and Rhode Island.

Data Breach

A data breach occurs when sensitive, protected, or confidential information (such as credit card numbers, name, birthdate, and social security number, among other data) has potentially been viewed, stolen, or used by persons who do not have permission to view or use that individual’s private information.

Victims of data breaches are susceptible to identity theft and other illegal uses of private information. According to the Department of Justice, “identity theft and identity fraud are terms used to refer to all types of crime in which someone wrongfully obtains and uses another person’s personal data in some way that involves fraud or deception, typically for economic gain.”

Potential Class Action Lawsuit

Santander Bank is suspected of breaching its employee’s security by leaking its employee’s name, birthdate, and social security number to persons who do not have permission to view this information. Employers are required to ensure their employee’s information is kept reasonably safe and may be liable to their employees for damages occurring when they have failed to do so.
