Consumers contract with Regus for services that include meeting rooms and video conferencing and which are marketed under names like Mailbox Plus.
Class Action Law Suit Claims Violation of Consumer Protection Laws
Some Regus PLC contracts require three-months written notice for cancellations from customers to prevent automatic renewals. Regus renews contracts for a one-year period if they don’t receive three months written notice. Regus also auto-renews shorter contracts if they don’t receive notice. This can sometimes be illegal in some states.
Many states have laws protecting from these automatic renewal contracts. For example, New York laws make companies like Regus give consumers’ notice of the auto-renewal provisions in contracts. Under N.Y. General Obligation Law section 5-903, any automatic renewal of service, maintenance or repair contracts is not enforceable by a company unless they give notice to the customer. Regus has to tell customers that the three months cancellation term is coming up and tell the customer 15 to 30 days before that happens.
It’s widely reported that Regus PLC and HQ do not provide this required affirmative notice. Plaintiffs seek damages equal to fees they were improperly charged after they were unable to cancel contracts.
